照见 Offscript 使用条款 · Terms of Use
This is version 1.0 of the Terms of Use, for Offscript 1.0 on iOS and the Android app (1.x). From version 3.0 on iOS and iPadOS, the current Terms of Use apply.
这份条款是你与 Arctura Technologies Inc.（加拿大安大略省注册公司，地址 Unit 10, 1338 Wellington Street West, Ottawa, Ontario K1Y 3B7, Canada；下称「我们」）之间关于使用「照见 Offscript」（下称「本 App」）的约定。安装或使用本 App，即表示你接受这份条款和隐私政策。通过 App Store 下载还同时适用 Apple 的标准许可协议（Licensed Application End User License Agreement）；两者冲突时，以对你更有利的为准。
1. 本 App 是什么
本 App 是一个自我觉察与练习工具：帮你在难受的那一刻停半秒、看一眼现在怎么了、事后记一句，并提供呼吸、注意力等自助练习与私人记录。
本 App 不是医疗器械，不提供医疗、心理诊断或治疗，也不替代专业帮助。不要因为本 App 的内容开始、停止或更改任何治疗或用药。真的很难受、有伤害自己或他人的念头时，请立即联系当地紧急服务或 App 内危机安全卡列出的援助热线。
2. 谁可以使用
你需要达到 App Store 商店页面显示的年龄分级（多数地区 13 岁），或你所在地允许独立同意使用网络服务的更高年龄。
3. 你的记录
你在本 App 里写下的一切都属于你。默认情况下，它们只存在你的设备上，我们不持有任何副本。如果你自行开启「备份到云端」，你授予我们仅为保存和向你返还该加密快照所必需的、有限的、可撤销的许可；我们无法读取其中的内容。恢复码由你保管——丢了我们无法补发，这是端到端加密的代价，也是它的意义。
4. 免费
1.0 版本完全免费，没有内购、订阅或任何价格。若未来引入付费功能，会在 App 内与 App Store 商店页面事先说明，并由 Apple 处理付款、续订与退款。
5. 合理使用
不要试图绕过、干扰或过载本 App 或其云端备份服务，不要在法律允许之外反向工程，不要把本 App 或其输出用于提供医疗服务、监控他人，或任何违法用途。我们可以在合理必要时中止滥用行为对服务的访问，并在可行时给予通知。
6. 变更与终止
功能会随版本演进而变化。我们可能维护、修复安全问题、下线某项功能，或在可行时提前通知后停止服务。你可以随时停止使用、删除 App，或用设置里的「销毁」抹掉本机与云端的一切。
7. 免责与责任限制
本 App 按「现状」与「可用」状态提供。在法律允许的最大范围内，我们不作任何默示保证，也不对间接、附带、特殊、后果性或惩罚性损失，或基于本 App 内容所做决定负责。本条不排除依法不得排除或限制的责任和法定权利。
8. 适用法律与联系
本条款受加拿大安大略省法律及适用的加拿大联邦法律管辖，但不排除你所在地强制适用的消费者保护规定。争议可提交安大略省有管辖权的法院，除非适用法律允许或要求其他法院。条款的重大变更会标注日期，并在需要时于生效前在 App 内提示。联系我们：support@arcturatech.com，或邮寄至 Arctura Technologies Inc., Unit 10, 1338 Wellington Street West, Ottawa, Ontario K1Y 3B7, Canada。
These terms form an agreement between you and Arctura Technologies Inc., a corporation registered in Ontario, Canada, at Unit 10, 1338 Wellington Street West, Ottawa, Ontario K1Y 3B7, Canada (“we”, “us”), about your use of the 照见 Offscript app (“the app”). Installing or using the app means you accept these terms and the Privacy Policy. Downloads from the App Store are also subject to Apple's standard Licensed Application End User License Agreement; where the two conflict, whichever is more favourable to you applies.
1. What the app is
The app is a self-awareness and practice tool: it helps you pause for half a second when things get rough, look at what is going on, note one line afterwards, and offers breathing, attention and other self-help practices together with private journaling.
The app is not a medical device and does not provide medical or psychological diagnosis, treatment, or a substitute for professional help. Do not start, stop or change any treatment or medication because of anything in the app. If you are in real distress or thinking about harming yourself or others, contact local emergency services or the support lines listed on the app's crisis safety card right away.
2. Who may use it
You must meet the age rating shown on the App Store product page (13 in most regions), or the higher age at which you may consent to an online service where you live.
3. Your entries
Everything you write in the app is yours. By default it lives only on your device and we hold no copy. If you turn on “Back up to the cloud”, you grant us a limited, revocable licence to store the encrypted snapshot and return it to you, and nothing more; we cannot read its contents. You keep the recovery code. If it is lost we cannot reissue it; that is the price of end-to-end encryption, and the point of it.
4. Free
Version 1.0 is entirely free: no in-app purchases, subscriptions or prices. If paid features are introduced later, they will be announced in the app and on the App Store product page first, and Apple will handle payment, renewal and refunds.
5. Acceptable use
Do not attempt to bypass, disrupt or overload the app or its cloud backup service, reverse engineer it except where law allows, or use the app or its output to provide medical services, to monitor other people, or for any unlawful purpose. We may suspend access needed to stop abuse and will give notice when reasonably possible.
6. Changes and termination
Features change as the app develops. We may perform maintenance, fix security issues, retire a feature, or end the service with reasonable notice when practicable. You may stop using the app, delete it, or use “Destroy” in settings to erase everything on your device and in the cloud at any time.
7. Disclaimers and liability
The app is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, special, consequential or punitive loss, or for decisions based on the app's content. Nothing here excludes liability or statutory rights that cannot lawfully be excluded or limited.
8. Governing law and contact
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without overriding mandatory consumer protections that apply where you live. Disputes may be brought before the courts with lawful jurisdiction in Ontario unless applicable law permits or requires another forum. Material changes will be dated and, where required, shown in the app before they take effect.
